With this service, content, e.g. large media files, are delivered via regionally distributed servers of external CDN service providers. Therefore, access data is processed on the servers of the service providers. Our service providers work for us within the framework of order processing. If you have any questions about our service providers and the basis of our cooperation with them, please use the contact option described in this privacy policy.

Further information on the processing of your data, in particular the transfer to our service providers for the purpose of order, payment and shipping processing, can be found in the following sections of this privacy policy. After complete processing of the contract or deletion of your customer account, your data will be restricted for further processing and deleted after expiry of the retention periods under tax and commercial law in accordance with Art. 6 para. 1 p. 1 lit. c DSGVO, unless you have expressly consented to further use of your data in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this statement. 3.1 Transfer of data to shipping service providers for the purpose of shipping

If you have given us your express consent to do so during or after your order, we will pass on your e-mail address to the selected shipping service provider on the basis of this consent in accordance with Art. 6 (1) p. 1 lit. a DSGVO, so that the shipping service provider can contact you before delivery for the purpose of delivery notification or coordination.

Pursuant to Art. 6 (1) p. 1 lit. c DSGVO, this is necessary to fulfill our legal obligation under Art. 7 (1) DSGVO to be able to prove your consent to the processing of your personal data, to which we are subject. 7.1 Use of google services

We use the technologies presented below from Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). The information automatically collected by Google technologies about your use of our website is usually transmitted to a server of Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA and stored there. For the USA, there is no adequacy decision of the European Commission. Our cooperation is based on standard data protection clauses of the European Commission. If your IP address is collected via Google technologies, it will be shortened before being stored on Google's servers by activating IP anonymization. Only in exceptional cases will the full IP address be transmitted to a Google server and shortened there. Unless otherwise specified for the individual technologies, the data processing is based on an agreement concluded for the respective technology between jointly responsible parties in accordance with Art. 26 DSGVO. Further information on data processing by Google can be found in Google's privacy policy (https://policies.google.com/privacy?hl=de).

Google analytics

For the purpose of website analysis, Google Analytics automatically collects and stores data (IP address, time of visit, device and browser information, and information about your use of our website), from which usage profiles are created using pseudonyms. Cookies may be used for this purpose. As a matter of principle, your IP address will not be merged with other data from Google. Data processing is carried out on the basis of an order processing agreement by Google.

For the purpose of optimized marketing of our website, we have activated the data release settings for "Google products and services". This allows Google to access the data collected and processed by Google Analytics and subsequently use it to improve Google services. Data sharing with Google under these data sharing settings is based on an additional agreement between responsible parties. We have no influence on the subsequent data processing by Google.

To create and run tests, we also use the Google Analytics Google Optimize extension feature.

Google ads

For advertising purposes in Google search results as well as on third-party websites, the so-called Google Remarketing Cookie is set when you visit our website, which automatically enables interest-based advertising by collecting and processing data (IP address, time of visit, device and browser information as well as information about your use of our website) and by means of a pseudonymous CookieID and based on the pages you visit. Data processing beyond this only takes place if you have activated the "personalized advertising" setting in your Google account. In this case, if you are logged in to Google while visiting our website, Google uses your data together with Google Analytics data to create and define target group lists for cross-device remarketing.

For website analysis and event tracking, we measure your subsequent usage behavior via Google Ads Conversion Tracking if you have reached our website via an advertisement from Google Ads. For this purpose, cookies may be used and data (IP address, time of visit, device and browser information, and information about your use of our website based on events specified by us, such as visiting a website or subscribing to a newsletter) may be collected, from which usage profiles are created using pseudonyms.

Google maps

For the visual presentation of geographical information, Google Maps collects data about your use of the Maps functions, in particular the IP address and location data, transmits it to Google and subsequently processes it by Google. We have no influence on this subsequent data processing.

Google recaptcha

For the purpose of protection against misuse of our web forms as well as against spam by automated software (so-called bots), Google reCAPTCHA collects data (IP address, time of visit, browser information as well as information about your use of our website) and carries out an analysis of your use of our website by means of a so-called JavaScript as well as cookies. In addition, other cookies stored by Google services in your browser are evaluated. No personal data is read or stored from the input fields of the respective form.

Youtube video plugin

To integrate third-party content, data (IP address, time of visit, device and browser information) is collected via the YouTube video plugin in the extended data protection mode used by us, transmitted to Google and subsequently processed by Google only when you play a video.

7.2 Use of Facebook services

Use of Facebook pixel

We use the Facebook Pixel as part of the technologies of Facebook Ireland Ltd (https://de-de.facebook.com/facebookdublin/)., 4 Grand Canal Square, Dublin 2, Ireland ("Facebook") outlined below. The Facebook Pixel automatically collects and stores data (IP address, time of visit, device and browser information, and information about your use of our website based on events specified by us, such as visiting a website or subscribing to a newsletter), from which usage profiles are created using pseudonyms. In addition, as part of the so-called extended data matching, information is collected and stored hashed for matching purposes, with which individuals can be identified (e.g. names, e-mail addresses and telephone numbers). For this purpose, when you visit our website, a cookie is automatically set by the Facebook Pixel, which automatically enables recognition of your browser when you visit other websites by means of a pseudonymous CookieID. Facebook will combine this information with other data from your Facebook account and use it to compile reports on website activity and to provide other services related to website use, in particular personalized and group-based advertising.

The information automatically collected by Facebook technologies about your use of our website is generally transmitted to a server of Facebook, Inc., 1601 Willow Road, Menlo Park, California 94025, USA and stored there. There is no adequacy decision of the European Commission for the USA. Insofar as the transfer of data to the USA falls within our responsibility, our cooperation is based on standard data protection clauses of the European Commission. Further information about data processing by Facebook can be found in Facebook's privacy policy (https://de-de.facebook.com/policy.php).

Facebook analytics

As part of Facebook Analytics, statistics on visitor activity on our website are created from the data collected with the Facebook Pixel about your use of our website. Data processing is carried out on the basis of an agreement on commissioned processing by Facebook. Their analysis is used for the optimal presentation and marketing of our website.

Facebook ads

Through Facebook Ads, we advertise this website on Facebook as well as on other platforms. We determine the parameters of the respective advertising campaign. Facebook is responsible for the exact implementation, in particular the decision on the placement of the ads with individual users. Unless otherwise specified for the individual technologies, the data processing is based on an agreement between joint controllers pursuant to Art. 26 DSGVO. The joint responsibility is limited to the collection of the data and its transmission to Facebook Ireland. The subsequent data processing by Facebook Ireland is not covered by this.

Based on the statistics on visitor activity on our website generated via Facebook Pixel, we operate group-based advertising on Facebook via Facebook Custom Audience by determining the characteristics of the respective target group. Within the scope of the extended data matching that takes place to determine the respective target group (see above), Facebook acts as our processor.

Based on the pseudonymous cookie ID set by the Facebook Pixel and the data collected about your usage behavior on our website, we conduct personalized advertising via Facebook Pixel remarketing.

Via Facebook Pixel Conversions, we measure for web analytics and event tracking your subsequent usage behavior when you have reached our website via an ad from Facebook Ads. The data processing is carried out on the basis of an agreement on commissioned processing by Facebook.

9. HACOY Music (streaming and listening statistics)

As part of your HACOY account we offer HACOY Music, our own playlists that you can stream inside the HACOY world. The music is hosted by us; we do not embed Spotify or any other third-party player, and no listening data is shared with such services.

Anonymous by default. When you play a track we record the play so that we can show aggregate figures such as the total number of plays and the most-played pieces. By default these records are not linked to you: they are stored without your account identifier and cannot be traced back to you. This anonymous, aggregated processing serves our legitimate interest in understanding and improving what our community listens to in accordance with Art. 6 para. 1 p. 1 lit. f DSGVO.

Personalised statistics only with your consent. If you switch on personalised statistics, we link your plays to your HACOY account so that we can show you your own listening history and favourites, and so that we understand what our members enjoy. The legal basis is your consent in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO. This setting is off until you actively turn it on.

Withdrawal and control. You can withdraw your consent at any time under "My Music", as easily as you gave it. When you withdraw, we also remove the personal link from your earlier plays, so that they revert to anonymous. Withdrawal does not affect the lawfulness of the processing carried out on the basis of the consent before its withdrawal. You can view the listening data we hold about you at any time and delete all of your listening data (plays, followed playlists and your consent record) with a single action.

What we store, and for how long. A play record contains the track and playlist, a timestamp and, only with your consent, your account identifier. We do not store the audio you hear or any recording of you. A playlist you follow is stored with your account so that your library is there when you return. Raw listening events are deleted automatically after 400 days; aggregate figures that cannot be traced to a person may be kept longer.

Recipients. Listening data is processed on our own infrastructure and is not passed on to third parties. Only authorised HACOY staff can see statistics, and named, person-level statistics are visible to them only for members who have switched personalised statistics on.

10. The HACOY app

This section covers the HACOY app specifically, in addition to everything above. It was added on 3 September 2026 and is pending review by our legal counsel.

Your account. You can browse the app without an account. If you sign in, we use the HACOY customer account you already have with our store, and we receive your first name and your email address from it. A session cookie keeps you signed in for up to seven days. You can sign out or delete your account at any time from your profile.

Deleting your account. Deleting your account in the app removes, on our servers: your marketplace listings and the photographs in them, the offers you made on other people's listings, your conversations and the delivery addresses inside them, and your entries in our size, feedback and gift records. Your session ends and the cookie is cleared. Orders already placed are kept where the law requires it, because a completed sale carries tax and accounting obligations.

The community marketplace. When you list a piece, we store the title, price, description, colour and up to six photographs you take or choose, together with your name and email address so buyers know who they are dealing with. Listings and photographs are visible to everyone using the app. When a sale is agreed, your delivery address is shared with the other party so the piece can be sent, and only then. Conversations between a buyer and a seller are stored so both sides can read them, and are visible to those two people and, where a report is made, to us.

Reports and blocks. If you report a listing we store what you reported, why, and that it was you, so we can act on it and so the same listing is not reported repeatedly by accident. A reported listing is hidden from the marketplace while we look at it. If you block someone, we store that choice so their listings stop reaching you.

Services you ask for. A repair request, an appointment, a suggestion, a vote in a design poll, a place at an event, a pre-order reservation or a question to us is stored with your name and email address so we can answer you. Body measurements you enter in Find my size stay on your device; if you choose "Send us your size" because you fall outside our current range, the measurements are sent to us so they can shape what we make next.

Applying for a job. If you apply through the app we receive your CV, your short video, your sentence about yourself, your name and your email address. We keep applications for six months unless you ask us to delete them sooner.

Ask HACOY. Questions you type into the assistant are sent to a language model that runs on our own hardware in Germany and are not passed to any third party. They are processed to answer you and are not used to train anything.

Checkout. Buying a piece takes you to our store at hacoy.store, where the checkout, the payment and the order are handled as described in the sections above. The app itself never sees or stores your card details.

What stays on your device only. Your saved sizes, favourites, saved images, wardrobe, language and theme, and the payment method you marked as preferred, together with the brand and the last four digits of a card, stay in your browser or app storage. They are not sent to us. Clearing the app's data or deleting your account removes them.

What we do not do. The app contains no advertising, no analytics and no tracking software of any kind. We do not build profiles, we do not sell data, and there are no third-party trackers in the app. Fonts are loaded from Google Fonts, which receives your IP address in the process; we are working to serve them from our own servers instead.

Your rights. The rights described in section 9 apply to everything in this section as well: access, correction, deletion, restriction, portability, objection, and a complaint to a supervisory authority. Write to [email protected].

11. Contact options and your rights

As a data subject, you have the following rights:

If you have any questions about the collection, processing or use of your personal data, for information, correction, restriction or deletion of data, as well as revocation of consent given or objection to a particular use of data, please contact us directly using the contact details in our imprint.

Right of objection

Insofar as we process personal data as explained above in order to safeguard our legitimate interests that prevail in the context of a balancing of interests, you may object to this processing with effect for the future. If the processing is carried out for direct marketing purposes, you can exercise this right at any time as described above. If the processing is carried out for other purposes, you will only have the right to object if there are grounds arising from your particular situation.

After exercising your right to object, we will no longer process your personal data for these purposes unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims.

This does not apply if the processing is for direct marketing purposes. Then we will not further process your personal data for this purpose.
